1.0      General provisions, definitions

1.1 These are the Terms and Conditions for Visitors of Museum Kranenburgh in Bergen, NH. All Dutch museums affiliated with the Dutch Museum Association have a General Terms and Conditions for Visitors.

 1.2 The term ‘The Museum’ is understood hereinafter to mean the organisation that manages and operates The Museum Premises, such as management, curators, and other museum officials who are authorised to act on behalf of this organisation.

1.3 ‘The Museum Premises’ is defined hereinafter as all the spaces (all indoor and outdoor areas) that fall under the legal and/or management authority of the museum management including, but not limited to, exhibition spaces, meeting rooms, catering areas, depot, terrace and garden and technical facilities.

1.4 ‘Visitor’ is defined hereinafter as anyone who, in any way whatsoever, directly or indirectly and whether or not in a school or group context, enters The Museum Premises during regular opening hours on the basis of an agreement concluded with The Museum Premises for the purpose of visiting The Museum in general, visiting an exhibition or attending an activity.

1.5 These Terms and Conditions for Visitors form part of every agreement between The Museum and a Visitor. These Terms and Conditions for Visitors apply to anyone who enters The Museum Premises without this person having made a direct or indirect agreement with The Museum.

1.6 Within reasonable limits, The Museum will do everything possible to ensure that the visit to The Museum Premises and the exhibitions and activities organised by The Museum take place according to the requirements of the Visitor. The Museum will make every effort to minimise any nuisance or inconvenience to the Visitor and to guarantee the safety of the Visitor as much as possible. The Museum welcomes suggestions from Visitors to improve the service.

2.0      Ticket sales, offers, and prices

2.1 All price quotations, announcements, or other information provided by The Museum are without obligation. The Museum only accepts liability for any errors made by The Museum itself in price quotations, announcements, or other information provided to the Visitor. This liability only applies to The Museum’s own information material insofar as it has recently been distributed by or on behalf of The Museum and is present and in use at the time of the claim. The Visitor is obliged at all times to show The Museum, upon request, a valid admission ticket to The Museum and any card or voucher that entitles the Visitor to a discount on the admission price to The Museum.

2.2 In the event of loss or theft of the admission ticket, the Visitor is not entitled to obtain a refund of the admission price or any other reimbursement. If the Visitor does not use the pre-purchased admission ticket, this is at the expense and risk of the Visitor. The same applies if the admission ticket is only valid for a specific time and/or date. Once an admission ticket has been obtained, it cannot be exchanged. In this case, the entry price will also not be refunded. The Museum will only refund the entrance fee paid by the Visitor if the Visitor has to leave The Museum Premises prematurely due to a calamity.

2.3 If the admission ticket or voucher appears to have not been obtained from The Museum or authority authorised by The Museum, The Museum may deny the Visitor access to The Museum Premises.

2.4 During the time of the pandemic caused by COVID-19, and when The Museum is allowed to open, The Museum will follow the ‘Safe and Responsible Reopening of Museums’ protocol issued by the Dutch Museum Association. Consequently, admission tickets to The Museum can be reserved online via the official website of The Museum (i.e. www.kranenburgh.nl). The Museum Café, the Museum Shop and the Museum Sculpture Garden are accessable only with a valid admission ticket.
The museum has a maximum capacity of 145 visitors in the Museum building when maintaining the 1.5 meter regulations.

2.5 Visitors are reminded of their own responsibility not to visit the museum in the event of health problems such as colds, fever and/or anxiety. In the case of these complaints, visitors are asked not to visit the museum. The 1.5-metre rule applies throughout the museum; a one-way walking route is indicated.

3.0      Visiting The Museum Premises

3.1 The stay of the Visitor on The Museum Premises is entirely at the expense and risk of the Visitor. During the visit to The Museum Premises, the Visitor must behave in accordance with what is acceptable under the normal rules of social conduct. The Visitor is also obliged at all times to comply with The Museum’s directions and instructions, such as those of the invigilators and security staff. If, in the opinion of The Museum, the Visitor acts contrary to these standards, directions, or instructions, in any way whatsoever, the Visitor may be denied, at the sole discretion of The Museum, further access to The Museum Premises without the Visitor having any right to reimbursement of the cost of the admission ticket or expenses incurred of any kind.

3.2 Parents or supervisors of minors must ensure that the minors they bring do not touch the exhibited objects and exhibition materials. Parents or other supervisors of minors are liable at all times for the conduct and actions of the minors they have brought with them. Teachers and other group supervisors should ensure that exhibited objects and exhibition materials are not touched by the group members they supervise. Teachers and/or the schools to which they belong and other supervisors are at all times liable for the conduct and actions of the pupils and/or group members they supervise. Parents or other supervisors of minors and/or teachers and other supervisors of groups are responsible for the safety of the relevant minors and/or group members they have brought with them.

3.3 The Visitor is, among other things, prohibited from the following on The Museum Premises:
a.        offering goods of any kind for sale or providing them free of charge;
b.        deliberately obstructing other Visitors or blocking the view of exhibited objects for prolonged periods;
c.        hindering other Visitors, for example by the use of mobile telephones, personal audio players, or other sources of noise nuisance;
d.        bringing pets and/or animals except for assistance dogs for the dissabled;
e.        smoking in the museum’s spaces;
f.         bringing food or other consumables or narcotics;
g.        bringing objects or substances that are dangerous in the opinion of The Museum, including, but not limited to, walking poles, umbrellas, bags larger than 30 x 30 centimetres, and rucksacks; items such as these can be stored free of charge in the cloakroom lockers.
h.        using prams and strollers other than with the permission of The Museum;
i.          touching the artworks.
 
3.4      The Museum may require inspection of any bags, or suchlike, carried by the Visitor. In addition, when entering or leaving The Museum Premises, Visitors may be asked at any time to cooperate with a security search. The Museum reserves the right to refuse a Visitor further access to The Museum Premises if the Visitor does not cooperate with this security search, without the Visitor being entitled to a refund of the admission price or any compensation.
 
3.5      Without the prior permission, written or otherwise, of The Museum or a museum employee, Visitors are forbidden to make photographic, video, or film documentation, or to have them made, using lamps, flash equipment and tripods. In addition, it is prohibited to publish or replicate photographic, video, and film documentation in any way and by any medium whatsoever, such as electronic media, without prior permission from The Museum. The Museum can at all times demand that equipment with which photo, video, and film recordings can be made to be handed over and take these into custody during the stay of the Visitor. If the Visitor refuses to surrender the equipment, The Museum may refuse the Visitor further access to The Museum Premises without the Visitor being entitled to claim a refund of the admission price or any compensation whatsoever
 
3.6      In the event of theft, destruction, or nuisance by the Visitor, including, but not limited to, the conduct referred to in article 3.3, The Museum will hold the Visitor liable for the damage and submit a report to the police. In addition, if a Visitor who has intentionally damaged an object during a visit to Kranenburgh, or if a Visitor has behaved in such a way as to justify the fear of damage, The Museum may deny access to The Museum Premises for a period to be determined by The Museum. The Museum reserves the right to forward to another museum the description of a Visitor who has damaged an object in The Museum. By entering The Museum Premises, the Visitor consents to the processing of their personal data for this purpose.
 
3.7     If the Visitor causes damage to an object of The Museum, The Museum reserves the right to recover all restoration and repair costs from the Visitor, without prejudice to The Museum’s right to full compensation.
 
3.8      If damage for whatever reason is caused by a Visitor who is a minor, respectively by members of a group of Visitors, then, as well as to the relevant Visitor, the parents, supervisors and/or the organisation that has booked a group visit are also held jointly and severally liable to The Museum for any damage caused by the minor or minors and/or the group member or members.
 
3.9      During the time of the pandemic caused by COVID-19 The Museum will follow the ‘Safe and Responsible Reopening of Museums’ protocol issued by the Dutch Museum Association. Consequently, the Visitor automatically agrees when purchasing a reservation to the specific hygiene measures (3.10) and Visitor conditions. The Visitor must strictly adhere to all directions for routing, hygiene, and behaviour that are given by means of visible signage in The Museum Premises or verbally by staff. Visitors who do not wish to follow these instructions may be asked to leave The Museum Premises.
 
3.10    In accordance with the aforementioned ‘Safe and Responsible Reopening of Museums’ protocol issued by the Dutch Museum Association, The Museum applies a standard of 1 person or 1 party per 10 m2 of floor space. For each space, the Visitor is informed of the maximum number of people allowed in that space and complies with this measure. Visitors are expected to keep a distance of 1.5 m from each other and The Museum staff and to follow all traffic rules offered for this purpose in the building. Visitors are expected to clean their hands as thoroughly as possible upon entry, when using the toilet, and where possible or necessary, using the cleaning products offered for this purpose at various places in The Museum.
 
4.0      Complaints and claims
 
4.1      Complaints and requests for claims related to the Terms and Conditions for Visitors must be submitted to The Museum in writing within eight working days after the day on which the visit took place. The Museum will not deal with complaints and requests for claims submitted after this period. The Museum investigates the complaint and in principle answers it in writing within 30 days of receipt. If the investigation has not yet been completed within this period, the complainant will be informed of this and the probable time by which the answer will be completed.
 
4.2      A claim is not possible concerning the following complaints and circumstances, among others, and will therefore never lead to an obligation for The Museum to pay compensation:
a.         complaints relating to objects from The Museum’s permanent collection that are not on display;
b.         complaints relating to the partial closure of The Museum Premises, such as partial closure as a result of the construction or dismantling of exhibitions and suchlike;
c.         complaints and circumstances relating to nuisance or inconvenience caused in any way by other Visitors, such as noise nuisance, inappropriate behaviour, theft, harassment, and suchlike;
d.         complaints and circumstances relating to nuisance or inconvenience caused by maintenance work, such as the setting up or renovation of spaces, and suchlike, on The Museum Premises;
e.         complaints and circumstances relating to nuisance or inconvenience caused by the malfunctioning of facilities on The Museum Premises.
 
5.0      Liability of The Museum
 
5.1      The stay of the Visitor on The Museum Premises is at the expense and risk of the Visitor. The Museum is only liable for matters and/or damage suffered by the Visitor or injury inflicted on the Visitor that is the direct and exclusive result of intent or gross negligence on the part of The Museum, on the understanding that only such damage is eligible for compensation for which The Museum is insured or should have been insured in all reasonableness and fairness.
 
5.2      The liability of The Museum for indirect damage, including damage as a result of the loss of profit or wages, missed savings, etc., are excluded.
 
5.3      The liability of The Museum is excluded for, among other things:
– damage resulting from the actions of third parties (Visitors);
– damage caused as a result of one’s own fault, such as by not following (in good time) the instructions given by The Museum;
 
5.4      The Museum is never liable for damage caused to vehicles belonging to Visitors; except if the damage occurred in car park on The Museum Premises and this damage is the direct result of intent or deliberate recklessness on the part of The Museum and/or its management.
 
5.5      If The Museum accepts goods or if goods are deposited, stored and/or left behind in any way by anyone, without The Museum stipulating any remuneration for this, The Museum is never liable for damage to or in connection with goods in any way whatsoever unless there is intent or deliberate recklessness on the part of The Museum or its management.
 
5.6      The Museum is never liable for damage caused by force majeure on the part of The Museum. Force majeure also includes any circumstance beyond the control of The Museum, which temporarily and/or permanently prevents access to The Museum Premises, exhibitions and/or compliance with the agreement, insofar as this does not already include civil disturbance, the outbreak of a pandemic, action by the police and/or fire brigade, strike, weather conditions, fire, electrical failure, and other severe disturbance
 
6.0      Found objects
 
6.1      Objects found by the Visitor on The Museum Premises can be handed in at the ticket desk.
 
6.2      In case the owner or entitled party of the found object comes forward, the owner or entitled party has the choice to collect the goods or to have them sent COD. In both cases, the owner or entitled party must provide proper proof of identity.
 
7.0      Applicability of other conditions
 
7.1      The applicability of these Terms and Conditions for Visitors does not affect the possible applicability of other conditions, contractual conditions, and/or regulations of The Museum.
 
8.0      Applicable law and choice of forum
 
8.1      Dutch law governs the agreements with The Museum and the Visitor conditions.
 
8.2      All disputes arising from the Terms and Conditions for Visitors between the Visitor and The Museum will be submitted exclusively for adjudication to the competent court in Alkmaar.
 
9.0      Other provisions
 
9.1      The Museum reserves the right to change its Terms and Conditions for Visitors.
 
9.2      Should it be established that one of the provisions mentioned above is null and void, that nullity will not affect the validity of the other provisions referred to in these Terms and Conditions for Visitors.
 
9.3      These Terms and Conditions for Visitors have been determined by The Museum management.
